Discrimination against male therapist in spa setting

What is the law concerning Spas being able to ask, "Do you prefer a male or a female therapist" ?
Would it be just as legit to ask, " would you like a black or a white therapist." The federal law is pretty clear that discrimiation won't be tolerated, however this practice continues.
I have spoken to lawyers, but they seem to believe it lies in a gray area. I have researched cases like the one against Marriot down in Arizona, but it was a non-hiring issue down there.
I am not a litigise person, but the fact is I make a third or more less than my female conterparts, and I believe it is all in the way we are pitched to clients. I have heard our front desk staff without prompting tell a client, "I am sorry, all we have left are guys", like we are the consilation prize.
I think it is not established law yet because no one has sued over this issue. We need an advocate. I am a Republican, so I think the ACLU wouldn't give me the time of day, but I am throwing it out there for somone to chew on because I think it is illegal, just not yet. ----
